General Terms of Business for Recruit Staff Online
1.1 In these conditions;
‘Client’ means the person who accepts these Terms and Conditions for the provision of services by Recruit Staff Online.
‘Services’ means the recruitment of personnel and for any consultation or advertising services.
‘Candidate’ means a person registered on the Recruit Staff Online database or known or introduced by Recruit Staff Online
‘Conditions’ means the Standard Terms and Conditions set out in this document and (unless the context otherwise requires) includes any Special Terms and Conditions agreed in writing between the Client and Recruit Staff Online.
‘Contract’ means the Contract for the provision of services by Recruit Staff Online for the client.
‘Writing’ includes e-mail, facsimile and comparable means of communication.
1.2 The headings in the Conditions are for convenience only and shall not affect their interpretation.
2.0 Basis of the sale
2.1 These Terms and Conditions of Business are between Recruit Staff Online and the Client and are accepted by the Client following commencement of any search or the introduction of an applicant, or presentation of their details, or an interview with, or the engagement of (which term includes employment under a contract of service or the services of, whether by the Client or any associated company of the Client).
2.2 No variation to these Conditions shall be binding unless agreed in writing between the authorised representatives of the Client and Recruit Staff online.
2.3 Any typographical, clerical or other error or mission in any literature, quotation, price, list, acceptance of offer, invoice or other document or information issued by Recruit Staff online shall be subject to correction without any liability on the part of Recruit Staff Online.
3.0 Fees Payable
3.1 The acceptance of our proposal for recruitment of personnel or consultation services, or otherwise the instruction by the Client to Recruit Staff Online to proceed with an assignment, will be taken as acceptance of our terms and conditions.
3.2 Where assignments are supported by a client instructed advertisement outside our normal advertising channels, the full cost will be charged to the client and must be paid before services commence.
Payment of candidate expenses (if requested) will be agreed prior to expenditure (wherever practicable).
3.3 A fixed fee of £199+Vat is payable for the recruitment service by Recruit Staff Online
3.4 No further payment is due other than the initial fee.
4.0 Payment Terms
4.1 Payment: All services are to paid immediately before recruitment services and job advertising can commence.
4.2 Late Payment: Late payment will void any guarantees. Legal action will be taken to recover any outstanding monies.
5.0 Warranties and Guarantees
5.1 We guarantee our candidates. Should a candidate leave the role within 30 days then we will re-run our services a total of 1 more time for free.
5.2 If no candidate is hired upon running the services for the second (free) time, the service shall be deemed complete and no further re-runs of the service will be completed without further payment.
5.3 If a candidate is hired upon the second (free) re-run of services but dismissed or leaves within the 30 day rebate period the recruitment service will be deemed completed and no addtional (free) re-runs or recruitment services can be completed without further payment.
Recruit Staff Online accepts no liability for any:
Loss, damage or delay arising from any failure to provide candidates
Loss of or damage to property or for any loss or injury to persons arising directly or indirectly from any act or omission by any candidate even if such act or omission is negligent, reveals dishonesty, misconduct, shows lack of skills or in any other way.
The client hereby acknowledges that it will not rely upon any statement or representation about an applicant made by or on behalf of Recruit Staff Online whether orally or in writing and the client will take all reasonable steps to be satisfied (without reliance on Recruit Staff Online) as to the suitability of an applicant before making any appointment.
7.1 References: Recruit Staff Online does not take up formal references and will not be held responsible for the taking up of references.
Recruit Staff Online is registered under the data protection act and conducts all business within set guidelines.
Candidate information is provided to the client in the understanding that this is in confidence and must not be passed to any third party.
8.1 If the client has a prior application from a specific candidate (however so received) then Recruit Staff Online must be informed immediately. Failure to do so (should the candidate be appointed) will be liable to full payment. If the prior application is over 12 months then the presentation of the candidate to the client will be deemed to be a new candidate.
8.2 Until a candidate has been offered a position and that offer has been finalised and accepted clients must not make direct contact with the candidate other than during interviews arranged by Recruit Staff Online or unless agreed with Recruit Staff Online. Any such contact will be treated as an approach outside of these terms and conditions and void and guarantees.
8.3 If candidate details are passed to another employer (including another part of any group of companies) then the client shall be liable to pay the full fee as if they had employed the candidate directly
8.4 Recruit Staff Online retains the right to contact appointed candidates to ensure a smooth transition beyond any trial period and for marketing purposes.
8.5 Recruit Staff Online will not approach client staff as a result of work being handled for other clients for a period of 12 months from the last assignment.
9.1 No waiver by Recruit Staff Online of any breach of contract by the client shall be considered as a waiver of any subsequent breach of the same or any other provision.
9.2 If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part of the validity of the provisions of these conditions and the remainder of the provisions shall not be affected.
9.3 These terms and conditions and any other contacts shall be governed by English law and Recruit Staff Online and the client agree to submit to the exclusive jurisdiction of the English courts.
10.0 Intellectual Property Rights
INTELLECTUAL PROPERTY RIGHTS
The contents of Our Site are protected by copyright and other intellectual property around the world. Unless otherwise stated, all the intellectual property rights in Our Site, including without limitation all artwork, pictures, images, graphics, text, materials, documents, RSS feeds, audio files, podcasts, video files, flash tutorials, graphics devices and code contained in it (together ‘Materials‘) on Our Site and the design, layout, look and appearance of Our Site are owned by us or our third party providers. You are permitted to use and download such Materials or extracts from Our Site, subject to all of the following:
- You must not, in any way, modify any such Materials, except as we expressly permit.
- No part of Our Site or its Materials may be reproduced or stored in any form or media, without our express prior written consent.
- Any rights not expressly granted in these Site Terms are reserved to us.
All product names, whether or not appearing in print or with the trademark symbol are trademarks belonging to us or our affiliates, related companies or licensors (unless otherwise noted). The use or misuse of these trademarks or any other materials, except as permitted herein, is expressly prohibited and may be in violation of copyright law, trademark law, the law of slander and libel, the law of privacy and publicity, and communications regulations and statutes.
